These Terms and Conditions govern your use of XGrowthEngine, operated by Tom Turcotte at www.xgrowthengine.com from Sault Ste. Marie, Ontario, Canada. By accessing or using the service, you agree to these terms. If you disagree, do not use it. You must be at or above the age of consent in your jurisdiction to use the service.

This agreement applies to our main web service. Our Chrome extension is governed by its own separate terms and privacy policy (available at www.xgrowthengine.com/extension-privacy).

1. Service Description

XGrowthEngine is a tool (including web service and Chrome extension) for individuals to find authentic engagement opportunities on X and Bluesky. Features are in early access; no uptime guarantees, but we strive for availability.

2. Accounts

Create via email signup with strong passwords (best practices enforced). You are responsible for account security; no sharing. We use browser fingerprinting for bot prevention.

3. Acceptable Use

Use for legitimate growth; no disrupting the service, uploading illegal media, hacking, or misuse. Violations may lead to termination.

4. Subscriptions and Payments

Plans: $30/month early access; $50/month pro (post-early access).
Via Stripe (credit card, etc.); auto-renews monthly. Cancel anytime via Stripe portal. Refunds within 30 days on request.

5. Term and Termination

Month-to-month; ends on cancellation or non-payment. I may terminate for breach. Post-termination, data access ends.

6. Intellectual Property

I own all code and service IP. You own your uploaded media and IP; grant me a limited license to provide the service, including processing via integrations like OAuth/atproto.

7. Warranties and Disclaimers

Service provided "as is" in early access, with no warranties (express or implied) to the extent permitted by law. No guarantees on uptime, performance, or data integrity.

8. Limitation of Liability

To the extent permitted by law, I am not liable for any direct, indirect, incidental, special, consequential, or punitive damages, including lost or corrupted data, arising from your use of the service, even if advised of the possibility. My total liability shall not exceed the fees you paid in the prior month.

9. Indemnification

You agree to indemnify, defend, and hold me harmless from any claims, losses, or expenses (including legal fees) arising from your misuse of the service, violation of laws, or infringement of third-party rights.

10. Governing Law

Ontario, Canada laws apply. Disputes resolved via arbitration in Ontario.

11. Changes

Notified via email with 7 days' notice; continued use accepts changes.

12. Force Majeure

Not liable for disruptions from natural disasters, political issues, etc. May revert to older builds if needed.
